NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE LOCATED AT: 205 LIMESTONE ROAD, FORT FAIRFIELD, AROOSTOOK COUNTY, MAINE AND DESCRIBED IN MORTGAGE RECORDED IN THE AROOSTOOK (SOUTH) COUNTY REGISTRY OF DEEDS AT BOOK 6211, PAGE 292 By virtue of and in execution of the Power of Sale contained in a certain Mortgage Deed given by MG Property Holdings LLC, a Maine limited liability company (Mortgagor) to Machias Savings Bank (Mortgagee) dated August 17, 2021, and recorded in the Aroostook (South) County Registry of Deeds at Book 6211, Page 292, of which Mortgage the undersigned is the present holder, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same there will be sold at Public Sale at 12 o'clock, P.M. on the 13th day of June 2024 on site of the mortgaged real estate at 205 Limestone Road, Fort Fairfield, Aroostook County, Maine, all and singular the premises described in said Mortgages, to wit: A certain piece or parcel of land situated in Lot #42, in the Town of Fort Fairfield, County of Aroostook and State of Maine, being a part of the land now or formerly owned by Wayne G, and Marilyn L. Thibeau as recorded in Volume 897, Page 295 at the Southern District Aroostook Registry of Deeds bounded and described as follows, to wit: The POINT OF BEGINNING being a 5/8" iron rebar set found at the intersection with the south line of the Plymouth Grant Township and the west line of land now or formerly owned by Harold W. and Gloria M. Kinney as recorded in Volume 1463, Page 105; thence, along the south line of said township, north seventy-three degrees zero Minutes zero seconds west (N 73° 00' 00" W) a distance of three hundred fifteen feet (315'), more or less, to the Weston Brook, so-called; thence, northerly along said brook to a point; thence, south seventy-two degrees thirty minutes zero seconds east (S 72° 30' 00" E) a distance of two hundred nine feet (209'), more or less, to a 5/8" iron rebar set: thence, continuing along the same course, a distance of six hundred fifty-eight and nine tenths feet (658.9') to a 5/8" iron rebar set on the westerly right-of-way or the East Limestone Road; thence, on a curve to the right, along said right-of-way, said curve having a delta 10-44-46, a radius of two thousand eight hundred fourteen and ninety-three one-hundredths feet (2,814.93') and an arc length of five hundred twenty-seven and ninety-six one hundredths feet (527.96') to point on a fence on said right-of-way: thence, north fifty-two degrees thirty-one minutes forty-five seconds west (N 52° 31' 45" W) along said fence, a distance of ninety-eight feet (98.0') to a point on said fence; thence, south fifty degrees thirty-three minutes zero second west (S 50° 33' 00" W) a distance of eight and one tenth feet (8.1) to a 5/8" iron rebar set; thence, south fifty degrees thirty-three minutes zero seconds west (S 50° 33' 00" W) a distance of seventy-six feet (76.0') back to the POINT OF BEGINNING. The above-described parcel of land containing a total of eight and four-tenths (8.4) acres, more or less, is based on a field survey and shown on a revised plat dated March 20, 1989, under the supervision of Daniel O. Bridgham, R.L.S. #1027. All bearings are magnetic as of 1989. The above parcel description was prepared by Daniel O. Bridgham, R.L.S. #1027 and is based upon his field survey and plat referred to above. Meaning and intending to describe the real estate conveyed by deed of Daniel J. Ayoob to MG Property Holdings, LLC, dated August 9, 2021 and recorded in the Aroostook (South) County Registry of Deeds at Book 6211, Page 290. Street Address: 205 Limestone Road, Fort Fairfield, Somerset County, Maine TERMS OF SALE: THE PROPERTY HEREIN ABOVE DESCRIBED IS BEING SOLD ON AN "AS IS" "WHERE IS" BASIS, WITHOUT ANY WARRANTY WHATSOEVER AS TO THE CONDITION, FITNESS, SIZE, HABITABILITY, MERCHANTABILITY, OR LOCATION OF THE PROPERTY OR THE STATE OF TITLE TO THE PROPERTY. In order to qualify to bid at the public sale, the bidder must provide a deposit of Ten Thousand Dollars and 00/100 Cents ($10,000.00). The high bidder at the public sale must increase the deposit to equal 10% of the total purchase price within 5 business days of the public sale. The deposit must be in the form of a bank check or certified U.S. funds payable to Machias Savings Bank. At the close of the public sale, the high bidder must sign a purchase and sale agreement with Machias Savings Bank, which agreement shall provide in part that (1) the purchaser will be responsible for all real estate transfer taxes, real estate taxes and other municipal charges attributable to the respective property unpaid and in arrears and for all subsequent tax years; (2) there shall be no contingencies for the purchaser's obligation to close; and (3) a closing of the sale shall be held within forty-five (45) days of the public sale where, upon presentation by Machias Savings Bank of the duly executed Release Deed, the remaining balance of the purchase price will be due in the form of a bank check or certified U.S. funds. Machias Savings Bank expressly reserves the right to bid without making the required deposit, to modify the terms of the sale set forth above, to add additional terms as it so wishes, and to authorize the mortgagor to sell the property prior to the public sale date.
