NOTICE OF Real Estate Foreclosure Auction Pursuant to 14 M.R.S.A § 6323 Land Located at 33 South Brewer Drive Brewer, Maine December 11, 2024 at 10:00 AM Auction will be held at The Law Office of Daniel J. Bernier 179 Main Street, Suite 304 Waterville, Maine 04901 Notice is hereby given that in accordance with an Order and Judgment of Foreclosure and Sale dated June 24, 2024 and entered by the Maine Third District Court Division of Penobscot, Maine in the action entitled Maine Equity Builders, LLC v. Marcos Nolasco Docket No. BANDC-REA-2023-00041; and wherein the Court adjudged a foreclosure of the mortgage deed granted by Marcos Nolasco et al. dated August 26, 2020 and recorded in the Penobscot Registry of Deeds, in Book 15669, Page 233; the period of redemption having expired; a public sale will be conducted on December 11, 2024 commencing at 10:00 a.m. at The Law Office of Daniel J. Bernier 179 Main Street, Suite 304 Waterville, Maine. The mortgaged premises which is located at 33 South Brewer Drive Brewer, Maine, and are sold on an "as is" basis. Reference should be had to said mortgage deed for a more complete legal description of the property to be conveyed. TERMS OF SALE: The Premises will be sold subject to all outstanding real property tax assessments and other municipal assessments, whether or not of record in the Penobscot County Registry of Deeds, as well as all real estate transfer taxes assessed by the State of Maine. The sale is also subject to such encumbrances as may be identified in the above legal description, or as may be recorded in said Registry and superior to the interests of Maine Equity Builders, LLC. Any person or entity intending to bid at the sale except Maine Equity Builders, LLC must deposit five thousand dollars ($5,000.00) U.S. funds with the auctioneer in cash, certified check or cashier's (or equivalent) check (checks to be made payable to Maine Equity Builders, LLC) as a qualification to bid. The deposit of the unsuccessful bidders shall be returned. The highest bidder will also be required to execute a purchase and sale agreement with Maine Equity Builders, LLC immediately after the close of bidding. The balance of the purchase price will be due and payable within 30 days of the public sale in United States funds. Conveyance of the property will be by release deed. Maine Equity Builders, LLC expressly reserves the right to modify and/or add terms and conditions pertaining to the sale of the Real Estate. Additional terms, including additions to and modifications of the terms and conditions, will be announced at the time of sale. Maine Equity Builders, LLC reserves the right to bid and, if the highest bidder, to pay for the Premises with a credit against all indebtedness owed to Maine Equity Builders, LLC by Marcos Nolasco, as evidenced by a certain Note and related loan documents dated August 26, 2020.
