By Findings & Conclusions dated August 16, 2016, the Bangor Board of Appeals made the following determination regarding an application filed by SHWP, LLC: "Applicant's request for a Certificate of Appropriateness to demolish the Engineer's House located at 635 State Street, Bangor is hereby granted." This determination was with respect to an application for a Certificate of Appropriateness previously filed.
Section 148 of the Bangor Code of Ordinances (the "Historic Preservation Ordinance") contains provisions regarding historic districts and buildings. In particular, Section 148-13(B)(4) of the Bangor Code of Ordinances provides as follows regarding a building which the owner intends to demolish:
The owner shall, for the period of time set forth and at a price reasonably
related to its face market value, make a bona fide offer to sell such
building or structure and the land pertaining thereto to any person, firm,
corporation, government or agency thereof or political subdivision or
agency thereof which gives reasonable assurance that it is willing to
preserve and restore the building or structure and the land pertaining
thereto. Prior to making such offer to sell, an owner shall first file a
statement with the Historic Preservation Commission identifying the
property, the offering price and the date the offer to sell shall begin.
The time period set forth in this Subsection B shall not commence
until such statement has been filed.
This Statement of Sale and Notice is intended to meet the requirements of the Historic Preservation Ordinance and the above-quoted section and shall be construed to effectuate that intention. If the Historic Preservation Ordinance requires any additional application for a certificate of demolition or removal to commence the 180-day period referred to in Section 148-13(B), this is intended to serve as such application.
The information required by the Historic Preservation Ordinance is as follows:
1) SHWP, LLC offers to sell the Engineer's House and the land pertaining
thereto to any person, firm, corporation, government or agency thereof
or political subdivision or agency thereof which gives reasonable
assurance that it is willing to preserve and restore the Engineer's House
and the land pertaining thereto.
2) The offering price is the nominal consideration of One Dollar ($1.00).
3) The offer shall commence on August 19, 2016, which is the date
following the date on which this Statement of Sale and Notice is filed
with the Historic Preservation Commission.
Any conveyance or transfer pursuant to the above offer shall be subject to all matters of record and shall be on an "as is-where is" basis without any representations or warranties from the transferor.
